Regulation and Competition

Economic regulation plays a fundamental role in our country as it sets the boundaries not only of the scope of action between the State and the private sector, but also between members of the private sector to ensure that the markets work as they should. It also imposes great challenges by requiring an appropriate articulation and balance of public policies and economic decisions, combined with compliance with administrative, sectorial and competition regulations.

At RCZ, the Regulation and Competition Practice includes legal counsel in all aspects of Decree Law 211 that set down the rules on the defense of competition and other antitrust regulations, in addition to a respect for the economic regulation of certain markets (telecommunications, banking, insurance, health care, sanitary services, gas, aviation, electricity transmission and distribution). Our lawyers also take into account economic and political variables.

The approach of this practice is preventive, achieved through the design and implementation of competition compliance programs and the review of commercial acts, contracts and policies in light of regulations. Our team provides legal counsel and defenses in investigations, inquiries and notices from the National Office of Business Crime Justice and in contentious and non-contentious damage indemnity and regulatory recommendation proceedings before the Antitrust Court and the Supreme Court in connection with cartels, unilateral conduct and mandatory notices of concentration transactions.
